Architecture Photography and Video Terms and Conditions
Standard License
You are paying to use the images to promote your brand or property, I retain the right to use and license them for the same purpose.
The copyright of photographs remains with the Photographer. The Photographer MAY license the images to other companies or individuals for the following use. The images taken by the Photographer are for promotional use (both web and print) by The Client to promote their brand or to market the subject property in the photographs. This includes posting to social media websites, their company website, print advertising for your business or the property, or any other reasonable promotional use. Sale or publication of the photographs for direct profit is not allowed without prior written permission from the Photographer.
I will only license the images to a business or individual whose work is in the image. The Photographer will advise all licensed parties if additional license is granted. Under the Standard License, The Client may not license the images to anyone else directly. Please direct any inquiries to me.
Exclusive License
You are paying to use the images to promote your brand, I cannot license them to anyone else. You are the only license holder.
The copyright of photographs remains with The Photographer. The Photographer may NOT license the images to any other company or individual without written consent from The Client. the images are exclusively for the use of The Client. The images taken by the Photographer are for promotional use (both web and print) by The Client to promote their brand. Media Delivery
Unless otherwise agreed upon, a reasonable delivery turnaround is 3-4 weeks.
The Photographer and The Client agree on a reasonable turnaround. Unless a specific timeline is agreed upon at the project’s outset, a reasonable turnaround time is 3-4 weeks from the last date of production.
Homeowner Privacy
The homeowner has a reasonable right to privacy. The Client and the Photographer will respect that.
The Photographer and The Client agree not to provide any identifying information in the photos. The Client’s and Photographer’s name and business information may be used to identify and give credit where due. Address numbers, family photos, names, or any other identifying elements must be removed by The Photographer before posting and/or delivering to the Client. It is The Client’s responsibility to review the images before posting to ensure privacy has been protected.
Model Release
I can use your images to advertise, but if I want to sell them to publications, I need to get a separate model release.
The Client grants the Photographer and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photographs of the Client for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. The Client hereby releases the Photographer and its legal representatives, heirs and assigns from all liability and claims in connection with the images.
Limit of Liability
In the case of an emergency, I will provide a backup photographer, or provide a full refund.
If a photographer is too ill or becomes injured and cannot supply the photography specified above, I will advise to reschedule the session.
The Photographer has working methods in place to prevent loss or damage to your images. However, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons in or beyond his control. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied.
